Dispute Between Life Technology And Tim Rifat Over The Psychotronic Generators Trademark
Tim Rifat sells a similar product called the Psychotronic Amplifier at his Phi-lord site and since he was concerned that we were hijacking his product idea we discussed the issue at some length with him back in 2006.
In the end, Tim Rifat agreed with us that harmonious coexistence was the best solution but however since that time he has made several dishonest, defamatory, malicious, libellous and wholly disingenuous statements about our company and products, suggesting that we are involved with satanism, dark forces, demonology and black magick.
It is more than obvious to anyone visiting our site and news blog that we have no other agenda than promoting the advancement of mind body and spirit through diet and lifestyle, healing our fellow man, and educating about health and wellness issues.
We hope that by publishing the email correspondence in its entirety we can demonstrate and prove that we have acted in good faith towards Tim Rifat. Despite Tim Rifat's continued personal attacks and hostility towards our company we would like to wish him success in life and business. After all, the most effective way to defeat hatred and darkness is through peace and light.
Life Technology has never engaged in mischief directed against our competitors, or made harmful or malicious statements about anyone and that includes Tim Rifat. Fear, anger and hatred are the roots of evil and the absolute antithesis of light love and peace which is what we stand for !
Tim Rifat, if there is anything more we can do to help resolve this issue please email Aurum or Kirsty at ormusalchemy@aol.com As we demonstrated in 2006, we are more than happy to cooperate and do what we can to resolve this dispute.
The email communication between ourselves and Tim Rifat is reproduced in its entirety as follows:

My name is Tim Rifat, and I am the owner of the Psi-Lord HyperSite.
I am very unhappy with the way you are claiming that the Psychotronic Generator is a new and unique product available only from you. My site has been selling these products for many years, and my books on the subject, published by Random, Vision and Century (most noticeably in this case Remote Viewing) substantially describe these items.
I am able to provide documentary proof that I have been selling this product since 1997, it is available on my sites, and is neither unique to you, or solely available from you.
I also am alarmed that your nine crystal set is almost identical to my own product, and can only think that you have lifted information from my sites.
Please advise me as to what you intend to do about this, as obviously the situation cannot continue.
Tim Rifat.

dear tim,
thank you for your email.
as you know psychotronic generator is a generic term and we are not guilty of infringing copyright by selling our psychotronic generator. the term was coined by russian researchers
we are aware that your product is known and sold as the psychotronic amplifier, a product which is based on the original russian psychotronic generator.
we use our own methods in the creation of these devices and again the method does not infringe on your intellectual property in any way.
despite the similarities in our products, we are not guilty of
1. trademark infringement
2. passing off
3. misrepresentation
4. unfair business practices
5. trademark dilution
since we are keen to comply with commercial law, we would be keen to cooperate with you if your attorney disagrees on any of these points of law .
we recognise your contribution to the world of psychotronics but you must recognise that your work has inspired others to follow your work.
thanks and kind regards

Hello aurum
My primary objection is that your site says:
This unique product is created and sold only by ourselves and consequently is not available to buy at any other internet location.
This unique product is created and sold only by Life Technology™ and consequently is not available to buy at any other internet location
This is not true, Psychotronic Generators are available at various locations, they are not unique to you.
You cannot claim to be the only site to sell Psychotronic Generators, it is not practical.
Tim.

dear tim,
thanks for your email.
whilst we agree that different types of psychotronic generator are available elsewhere, the product we create is quite unique.
we are aware that you use ritual methods as described by dion fortune in the creation of your psychotronic amplifier , however we use psychotronic/radionic methods which we have devised ourselves. we believe our method to be more effective, consistent and reliable than ritual methods, however since psychotronic power is impossible to measure, that is merely a statement of opinion not fact.
we respect your work in the field of psychotronics but as in any field of science ,you are well aware that innovation occurs and the original knowledge evolves.
we have evolved the work of russian researchers, dion fortune and yourself in the creation of these devices. in fact, we give your name credit at our site. several years ago we did a lot of work with a gifted clairaudient who was able to communicate with an entity who claimed to be the archangel mikhail. this entity provided us with a lot of useful specific information on how to refine the methods we were already using.
even though the channel had no idea of what the information meant, it was very clear to us what was being communicated.
we have not disclosed those methods.
we are aware that there are only two suppliers of psychotronic generators in the world, ie you and ourselves. we can surely coexist amicably without interfering with one another's business.
we wish you well with your website and books which are excellent by the way.
kindest regards,
aurum solis

Hello aurum,
The name 'Psychotronic Generators' cannot be considered unique to you. Your text very clearly makes it sound as though you are the only company producing Psychotronic Generators, as opposed to the only company selling your own version, do you see the difference?
'Life Technology Psychotronic Generators' would be unique to you, just as 'Tim Rifat Class Psychotronic Generators' could be unique to us.
I also would like a harmonious co-existance if it's possible.
I would like to suggest a revision of trademark, where yours is branded with Life Technology and ours with Tim Rifat. That way, as concurrent trademarks are intended to be, each trademark will refer to our own product, whereas at the moment yours refers to the entire technology.
In the final analysis, no-one person, company, can lay claim to the sole use of the name Psychotronic Generator in it's pure form.
I hope this email will not offend you, nothing of the sort is intended, but I am still alarmed that you appear to be laying sole claim to the term/technology of Psychotronic Generators, and not to your own product line, as is appropriate.
I look forward to your reply,
Tim.

ive run a search for that material just now and according to google it is located in 419 locations on the internet.
we will of course ensure that any material that is rightfully yours is removed as soon as possible.

Thank you for removing the referenced text.
I am aware that many people may be using the text. Some of them have permission to do so.
I cannot deal with all these cases personally and instantly, but as they come up, I do, of course.

hi tim,
our trademark is not registered, but as you know it is not strictly necessary to register a trademark to afford it protection under commercial law.

Thank you for the information Aurum,
I would respectively ask you to rebrand your products as Life Technology Psychotronic Generator, (to use Psychotronic Generator) or to prefix with a product name, i.e. Psychic Ability Psychotronic Generator, etc...
to say Psychotronic Generator followed by a trademark symbol does imply that you have trademarked the term Psychotronic Generator, which, as you have not actually registered it, you have not, and I think it unlikely that it would pass, as you say, it's generic, and generic marks are declined with the 'relative' reason.
You cannot lay claim to being the sole proprietors of an entire technology, and if you think about it before responding I'm sure you will see the sense in this. I am retrofitting with the name Tim Rifat Class Psychotronic Generator, and I feel it only fair that you lay claim only to your product line, and not all Psychotronic Generatrors as a technology and a principle in general.
For instance: The Health Psychotronic Generator, could well be tolerated with the trademark symbol after. This is providing, that the name does not match a pre-existing product in our galleries, there should be no crossover, of course if I have a product called Love Psychotronic Generator, and you then label a product the same, this is intellectual property theft, it really is a first come first served basis for concept/design, and I have been here a very long time.
I hope you see the difference between The Health Psychotronic Generator, and Psychotronic Generator on it's own.
I am aware that there are many sites selling Psychotronic Crystals - but none that I have examined have attempted to claim ownership of the entire technology by purporting to have trademarked the term Psychotronic Crystals. If they do, I will be in contact with them also.
Please advise me of your intentions.
Tim.

dear tim,
thanks for your suggestion.
i do understand the point you are making.
i am content to add lifetech or 'life technology' to the term 'psychotronic generator' at the psychotronic.htm page effectively creating a new and valid trademark name. i will ask my webdesign guy to check if the term occurs on the other pages and to make the necessary modifications.
these modifications will be carried out as soon as i can get hold of my webdesigner.
kind regards
Aurum

Hi Aurum,
Many thanks.
In summary, I think we've agreed that you will:
remove the quotation from my book
remove the portions of pages that imply that Psychotronic Generators can be bought only from you
add lifetech or life technology to the term Psychotronic Generators.
I agree that this will create a unique and viable trademark for your purposes.
I will in turn retrofit with 'Tim Rifat Class' in turn creating my own unique and viable trademark - and this way the two sites should be able to co-exist harmoniously.
Thank you for talking this over with me, I appreciate your prompt responses.
Tim.

dear tim,
yes it is our intention to comply fully with your requested suggestions. the changes will be implemented at the website as soon as possible.
with regards to the statement
'This unique product is created and sold only by Life Technology™ and consequently is not available to buy at any other internet location.
i am assuming the statement is acceptable if the statement applies to one of our own trademarked products ie 'the lifetech psychotronic generator tm' and does not apply to the generic term psychotronic generator.
please could you clarify that point.
thanks and kind regards
Aurum

I agree, referencing one of your own product line rather than the generic term is completely acceptable.

dear tim,
we will be adding the following statement to our lifetech psychotonic generators page to further clarify the situation.
thanks
aurum
Psychotronic Generator is a term which was introduced by Russian Psychotronic Research. At the present time, there are only two companies in the world who are actively engaged in the innovative research and development of Psychotronic Generator Technology. The companies involved are Life Technology™ and Tim Rifat.
